Supreme Court issues TRO for COMELEC to stop proclamation of Party-List winners

The Commission on Elections (COMELEC) in the light of a set of rules issued by the Supreme Court has disqualified the Senior Citizens Party and 10 others from the party-list race and their votes to be considered stray votes

The Comelec has already proclaimed 38 party-list groups for the 53 seats allotted for sectoral representation in the House of Representatives last May 24 and 28. Only five seats remain unoccupied.

Brillantes said that if the SC allows the counting of votes of disqualified party-lists, including Senior Citizens which got at least 600,000 votes, it would affect the final results of the party-list race.

“We now leave everything to the SC,” he said.

“Most of the 12 [disqualified party-list groups] no longer have any chance of getting a seat. Maybe only the top two will have a chance to get a seat, depending on the final decision of the SC,” Brillantes said.

In effect, Brillantes said the TRO validates the previous proclamations of the Comelec.

“My interpretation of this [TRO] is that they validated already our previous proclamations, only the five [remaining unproclaimed] have an issue,” Brillantes said.

“I still believe that the remaining five are still the ones which will be proclaimed, Senior Citizens will still not be able to win, we have to maintain our position that they are disqualified,” he said.

The group was disqualified by the poll body due to alleged illegal term-sharing of its representatives in Congress.
Petitioners said their disqualification was a violation of the constitutional right to due process, saying they were not given a chance to contest the Comelec ruling.

They also argued the violation of term-sharing policy was not among the grounds for disqualification laid down by the high court in its decision last month on 52 disqualified party-list groups.
They added their disqualification would disenfranchise the over 600,000 votes they garnered in the elections.

The Senior Citizens placed 10th in the party-list race after garnering over 600,000 votes.
But Brillantes said the high tribunal would still issue a resolution on the merit of the cases of disqualified party-list organizations.
The TRO was issued after several disqualified party-lists asked the high court to order a recount of votes.

Brillantes said he will request the SC for the case to be resolved before June 30 so that when Congress resumes session, all 58 partylists will have been proclaimed.

Comelec is required to file their comment on the TRO within 10 days.

Cops found videos and photos to prove teacher was having sex with family dog

A teacher lewd acts of bestiality was busted after unlikely footage was found of her having sex with her family’s dog, police said.

A special education specialist in Hartford County, Maryland, Stephanie Mikles, 45, was arrested and charged with unnatural or perverted sexual practice. Footage allegedly showed her having a variety of sexual acts with the canine.

She denied the charge. She was suspended from her job pending the outcome of the case.

Mikles is out of jail on $5,000 bond.

If convicted, she faces up to 10 years in prison and a $1,000 fine. The dog, reports ABC2, is still living with the family.

A couple was proven to have committed for over 2 years physical and sexual violence against their sons, aged 6 and 7 and a third boy, 17, from the mother’s previous relationship.
The couple, a man, 30, and a woman, 39, were meted 17 years imprisonment by a Norwegian court Thursday for violence, rape and incestuous relations with their 3 sons.

The boys said they were denied food, beaten and locked up nude in the basement, raped and made to abuse each other, in a room especially set up by their parents.

The couple moved the family 14 times to avoid being found.

The two youngest boys were placed in foster homes.

The parents pleaded innocent to the charges saying they were fabricated.They have appealed the verdict.

The court called it the country’s worst sexual abuse case.


An African Village mourns the passing of a dedicated Peace Corps Volunteer

As Peace Corps volunteer she accepted her African assignment without any murmur or complaint. She knew what to do. She immersed herself way far into the ways, mores and traditions of her village assignment of Jukwa Krobo in order to gain the trust and confidence of the village folks.

Soon she won the hearts and cooperation of the village people, young and old alike. It was necessary and a must if she was to put up programs and projects successfully in order to effect change in the ways, mores and tradition of the village folks she was sworn to serve. In no time she gained their respect and was looked up to as an exceptional role model especially for the younger set of generation.

But, unluckily, misfortune took its toll. Dani or Danielle Dunlap, 25, of Atlanta a Peace Corps volunteer got sick and was reported and confirmed to have died in Ghana on Sunday.

Peace Corps Deputy Director Carrie Hessler-Radelet on the Peace Corps website gave the name of the deceased volunteer, while an spokeswoman for the US Embassy in Accra Zainab Mahama confirms that a Peace Corps volunteer has died in Ghana but failed to provide details.

Hessler-Radelet said that Danielle, known to her friends as Dani, was a widely respected and ambitious Peace Corps volunteer who was an exceptional role model for the youth of Jukwa Krobo. The entire Peace Corps family including the African village folks are grieving over her tragic loss.

Danielle Dunlap’s family said she was in the process of building a health clinic for villagers when her inevitable death occurs. Her aunt Elvenia Gibson said she went home on Christmas but didn’t bother to acquire gifts for herself, she wanted financial donations to build a clinic. Danielle’s grandfather. The website also said Dunlap arrived in Ghana in June 2011.

A fresh graduate of Brown University with a bachelor’s degree in neuroscience, she focused on HIV and malaria prevention.

I highly commend this Peace Corps Volunteer program of the United States of America. With this recent death of Peace Corps Volunteer Danielle Dunlop, I came to realize that from its inception up to this time, a time frame of 52 years, the program is very much alive and kicking. Digging and reading about the program, I came to compare the US Peace Corps Volunteer as a healthy tree that keeps growing strong as the years go by, with its branches and roots spreading far and wide

To President John F Kennedy for establishing the Peace Corps on March 1, 1961; Sargent Shriver, its founder and Visionary Father; Warren W. Wiggins, major architect and organizer of the Peace Corps, whom I consider pillars and to the more than 200,000 Americans who have served with the Peace Corps to promote a better understanding between Americans and the people of 139 host countries, my heartfelt gratitude.

In my simple understanding, in general, the Peace Corps has brought peace, light, understanding, technology, education, sanitation, health, others to the farthest and darkest corners of the earth.

Life in prison for killer of Peace Corps Volunteer

Justice came Monday for Julia Campbell, a Peace Corps volunteer who gave up a journalistic career in the United States to work with the poor in the Philippines but found death instead on a deserted mountain trail in Ifugao province.

A judge found 25-year-old woodcarver Juan Donald Duntugan, the lone suspect in the April 8, 2007, killing of Campbell in Batad village, guilty of murder and sentenced him to life imprisonment.
Duntugan, wearing a striped green shirt, showed little emotion. He immediately turned to his jail escort and thrust his hands for handcuffing after the decision was read out to him in English in open court.

But he sobbed as the verdict was translated in the Ifugao dialect.
“This is justice for Julia,” Prosecutor Reynaldo Agranzamendez told The Associated Press by telephone. “But justice can only compensate, it cannot bring her back to life.”

Judge Ester Piscoso-Flor of the Regional Trial Court also ordered Duntugan, a father of three, to pay the family of Campbell P39.7 million in actual, moral and exemplary damages.

The judge said Duntugan killed Campbell “with the use of treachery and abuse of superior strength” but that she could not impose the death penalty because it had been banned in the Philippines.

The 40-year-old Campbell, a volunteer English teacher in Albay province where she waded through floods to help victims of Supertyphoon “Reming,” was posthumously awarded the Order of the Golden Heart “for her dedicated service to the Philippines” by President Gloria Macapagal-Arroyo two months after she was murdered.

Campbell was bludgeoned with a rock on Easter Sunday last year while trekking alone in a mountain path in Batad village, about 10 kilometers from the town proper. Read More

Mayweather scores 117-111 on three judges vs Guerrero

Floyed Mayweather Jr. executed a masterful unanimous decision victory over former multiple-division titleholder Robert Guerrero at the MGM Grand Arena, Las Vegas, winning by the scores of 117-111 on all scorecards of the three judges.

Defeating Miguel Cotto on May 5 last year, Mayweather (44-0-26 knockouts) at 36 was still fast and accurate, landing over 60 percent of his power shots on the lefthanded Guerrero (31-2-1, 18 Kos), who had held titles at featherweight and junior lightweight, and interim belts at lightweight and welterweight.

Guerrero of Gilroy, California, showed promise in the first two rounds, landing solid left crosses on Mayweather. Mayweather, who has won titles in every division from 130 to 154 pounds, took control from the third round on, hitting Guerrero with hard right crosses that sapped Guerrero’s confidence each round.

The encounter increasingly tilted to Mayweather’s side beginning round five, when a right cross from him rocked Guerrero back on his heels.

Guerrero who was visibly lacking in speed missed his power shots too often. Or, they were parried by Mayweather’s gloves, adding to Guerrero’s frustration.

Quoting Muhammad Ali, Mayweather’s father shouted from the ringside: “The hands can’t hit what the eyes can’t see.”

Guerrero’s face manifested visible mark of punishment in round eight. Mayweather’s right cross opened up a cut above Guerrero’s left eye, but Guerrero a true fighter that he was though wounded continued to come forward to absorb more beatings.

Obviously, irked with the absence of hot action, the crowd booed the last 30 seconds of the fight.

When asked whether Mexican fan favorite and WBC/WBA unified junior middleweight champion Saul “Canelo” Alvarez (42-0-1, 30 KOs) would be his opponent in September, Mayweather was elusive.

The first bomb exploded near the finish line of the Boston marathon on April 15. And one of the victims was Jeff Bauman, Jr. 27, of Chelmsford, Massachusetts who had both legs blown off. He was there waiting and cheering his girlfriend runner Erin Hurley and friends to reach finish line.

Emergency responders and volunteers, including Carlos Arredondo rushed to the scene. Arredondo lifted the bleeding Bauman to a wheelchair and did first aid to stop Bauman’s wounds from bleeding. Arredondo torn up a sweeter to devise tourniquets, saving his patient from death due to lose of blood, then rushed him to an ambulance.

As told to Bloomberg news by his brother Chris, Bauman regained consciousness from surgery and wrote a note which reads: “bag, saw the guy, looked right at me.” The FBI took opportunity of the situation and interviewed the gutsy Bauman. He related having seen a man who was wearing sunglasses and a black jacket; who left a bag at his feet that exploded minutes later.

This provided a lead for FBI to look for somebody as they sift through massive amount of footage from surveillance cameras and digital images contributed by the public

A man with a backpack was singled out that Wednesday. FBI’s Special Agent Richard DesLauriers called it “a single person of interest.” The public got wind of the break and rumors have it that a suspect had been identified and that an arrest has been made.

DesLauriers proved that he was qualified for the task. He had learned from experience how going public can result in the apprehension of even wily fugitives.

His colorful experiences in counterintelligence work have instilled in him the importance of seeing who keeps company with whom. He was the lead agent in the case that toppled down a Russian spy ring, including the couple who inspired the TV show The Americans

He held off a bit longer despite pressure to confirm that there was indeed a significant development in the case, which authorities and public alike all wanted so desperately to be solved.

But DesLauriers later said that they were determined to find out if the suspect was acting alone or in cohorts with others.

In the course of searching for more images of the young man Bauman had described, investigators soon came upon video footage of that person of interest walking in tandem with another young man with a backpack. The two seemed to maintain a constant distance apart, as if making a conscious effort of not looking like they were together. They seemed to have a shared feeling of satisfaction.

The FBI are now provided with images of the second young man leaving his backpack at the exact location of the second bomb and then sprinting away before the explosion. And as for the first bomb that went off earlier, Bauman had already described it to them how it was planted.

At 5 in the afternoon of Thursday, DesLauriers was ready to tap the same power that had produced the crucial break in one of the biggest cases in Boston. Whitey Bulger was captured after an Icelandic woman saw a CNN report about an FBI TV ad asking people to keep a lookout for the gangster and his girlfriend. The woman recognized the pictures and Bulger was soon in custody on charges that include 19 murders.

DesLauriers now released images of the two young men, describing them as Suspect No. 1 and Suspect No. 2.

Today, he said, we are asking the public’s help to identify the two suspects. With media’s help, these images will be delivered directly into the hands of millions around the world.

Suspect No. 1 matches Bauman’s description, wore a cap, sunglasses, a black jacket and tan pants. He had a backpack that seemed quite heavy.

Suspect No. 2 wore a white cap with brim turned backward, making his face more visible. He wore a dark jacket, a gray hoodie and dark pants. He carried a backpack slung on his right shoulder.

In the image where the second bomb was placed. Suspect No. 2 can be seen from the railing at the edge of the marathon route. He’s talking on a cellphone in his left hand. His right shoulder shows no longer the strap of his backpack which he had apparently set it down and briskly walked away before the blast.

However, the first big break in the case reportedly came after Bauman asked a nurse in the recovery room for a pen and paper and wrote the note saying he had seen one of the bombers.

And this is how a bombing victim himself helped identify, name and apprehend the April 15 Boston Marathon bombers, brothers Tamerlan and Dzhokhar Tzarnaev.

Man wrongly linked to Boston bombings discovered dead

On social media platforms such as facebook, twitter and reddit tremendous attention was focused on Sunil Tripathi, 22, whose image closely resemble to the that of the video stills released by the FBI as a Boston bombing suspect, said Sunil’s father last week, WPVI-TV reported. But later a statement was issued clearing the name Sunil Tripathi; that Sunil was not a suspect, the report said.

A crowd sourcing groups eyeing photos released by the FBI of a suspect wrongly submitted via Reddit, a social news website, that the person in a baseball cap strongly resembled Sunil Tripathi who was then missing.

The missing Sunil Tripathi is now found. His dead body was fished from the water off Rhode Island and identified as the Brown University student mistakenly linked by amateur sleuths on Reddit to the Boston bombings. Sunil’s body was positively identified through dental records, said health department spokeswoman Dara Chadwick on Thursday.

Last seen March 15, Sunil’s date of death and cause of death weren’t determined. Police said no signs of trauma were established and that the investigation could take months. Sunil’s body was discovered by the Brown University crew team.

Sunil was on leave from the Ivy League school but was living in an apartment near campus in Providence, R.I., with other students.

Reddit general manager Erik Martin apologized to the Tripathi family for the pain that they have had to endure. He said that the Reddit staff and the millions of people on Reddit around the world deeply regret that this happened.

An accomplished saxophonist, Tripathi grew up in Radnor, Pa., outside Philadelphia, and was studying philosophy, the university reported.

Brown President Christina Paxson said that he was known to be a serious student and a brilliant writer, and that Sunil will be remembered for his generous spirit.
